Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. The Service

Ethic Link is a web-based application designed to facilitate secure and confidential reporting of unethical conduct, fraud, or other irregularities within an organization (the "Whistleblowing Reports"). The Service provides a platform for individuals to submit reports and for designated personnel within subscribing organizations to receive and manage these reports.

2. Whistleblowing Reports and Confidentiality

• User Responsibility: Users submitting Whistleblowing Reports through Ethic Link are solely responsible for the accuracy and veracity of the information provided.
• Confidentiality: We are committed to maintaining the confidentiality of Whistleblowing Reports to the extent permitted by law. However, please be aware that we are a service provider facilitating communication; we do not investigate or act upon the reports ourselves. The responsibility for investigating and acting on reports lies with the subscribing organization.
• Anonymity: While the Service may offer features designed to support anonymous reporting, we cannot guarantee absolute anonymity, as the nature of online communication inherently carries some risks. Users should carefully consider the information they choose to share.
• Legal Obligations: We may be legally obligated to disclose information, including Whistleblowing Reports, if required by law, court order, or governmental authority.

3. Free Trial and Subscription Fees

• 7-Day Free Trial: We offer a 7-day free trial period during which you can evaluate the Service. During the free trial, you will have access to full functionality. No payment information is required to start the free trial. Upon the expiry of the 7-day free trial period, your access to the Service will automatically terminate unless you subscribe to a paid plan.
• Ethic Link Subscription Plan: Access to Ethic Link is provided on a subscription basis after the free trial. Our standard subscription plan includes the following features:
  • 5 Users: Access for up to 5 distinct users within your organization to manage the platform.
  • 20 Extra fields: Adding up to 20 additional fields to the whistleblower form.
  • 5 Extra pages: Adding a maximum of 5 additional pages to the public site.
  • 5 Reminders: Adding a maximum of 5 reminders.
  • Whistleblower forms: Unlimited number of whistleblower forms submission.
  • Branded Whistleblower Page: A customizable, branded whistleblower reporting page for your organization.
  • Secure Reporting Inbox: A secure, encrypted inbox for receiving and managing Whistleblowing Reports.
  • Access Management: Tools to manage user roles and permissions within your organization's Ethic Link account.
  • Multi-Language Support: Support for multiple languages in the user interface and reporting process.
  • Email Support: Dedicated email support for technical issues and inquiries.


• Subscription Fees:
  • Monthly Subscription: €30.00 (thirty Euros) per month, including 19% Romanian VAT.
  • Annual Subscription: €300.00 (three hundred Euros) per year, including 19% Romanian VAT.


• Payment: Subscription fees for paid plans are billed in advance on a recurring and periodic basis (e.g., monthly or annually), depending on the subscription plan you select. Payment must be made through the payment methods offered by the Service.
• Invoicing for Romanian Customers: For customers residing in Romania, the invoice will be sent through the national electronic invoicing system (e-Factura) within a maximum of 5 business days from the issuance date, as per current legislation.
• No Refunds: ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE. This applies to both monthly and annual subscriptions, regardless of usage or cancellation during a subscription period.

4. Account and Security

• Account Creation: When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
• Account Security: You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for all activities or actions that occur under your account and/or password. You must notify us immediately of becoming aware of any breach of security or unauthorized use of your account.

5. Intellectual Property

The Service and its original content (excluding Whistleblowing Reports submitted by users), features, and functionality are and will remain the exclusive property of SELFSOFT TECH SRL and its licensors. The Service is protected by copyright, trademark, and other laws of both Romania and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SELFSOFT TECH SRL.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Limitation of Liability

In no event shall SELFSOFT TECH SRL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data or other intangible losses, resulting from your access to or use of or inability to access or use the Service; any conduct or content of any third party on the Service; any content obtained from the Service; and unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

SELFSOFT TECH SRL its subsidiaries, affiliates, and its licensors do not warrant that

• the Service will function uninterrupted, secure, or available at any particular time or location;
• any errors or defects will be corrected;
• the Service is free of viruses or other harmful components; or
• the results of using the Service will meet your requirements.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

11. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
